Terms of Use | Dead Souls Daily

Effective Date: June 15, 2026

By downloading, accessing, or using Dead Souls Daily (the "App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App. Life is hard enough without entering into contracts you despise.

1. The Service

Dead Souls Daily provides curated quotes from historical literature. The core service (receiving one quote per day) is provided free of charge. Access to historical quotes (the "Archive") requires a Premium purchase.

2. Subscriptions and Purchases

We offer premium features through auto-renewing subscriptions and one-time lifetime purchases. All payments are handled by the store you downloaded the App from — Apple's App Store on iOS, or Google Play on Android — and never by us directly. By selecting a premium option, you agree to the following pricing and payment terms:

Billing: Payment will be charged to your Apple ID account, or to the Google account associated with your Google Play purchase, at the confirmation of purchase.
Auto-Renewal (Annual Subscription): The subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period.
Cancellation: You can manage and cancel your subscriptions in your App Store account settings on iOS, or under Payments & subscriptions in Google Play on Android. Canceling a subscription will not immediately revoke access; you will retain premium features until the end of your current billing cycle.
Refunds: All payments are processed entirely by Apple or by Google. We cannot issue refunds directly. Refund requests must be routed through Apple Support or Google Play Support, depending on where the purchase was made.
Platform Independence: Purchases are tied to the store account that made them. A Premium purchase made on iOS cannot be restored on Android, or the reverse, as the two stores maintain separate and unspeaking records of entitlement.

3. Intellectual Property

The literary quotes featured within the App are in the public domain. However, the curation, compilation, design, interface, code, and overall aesthetic of Dead Souls Daily are the exclusive property of Dead Souls Daily and are protected by copyright and intellectual property laws. You may not reverse-engineer, copy, or distribute the App's proprietary design or software.

4. Disclaimer of Warranties and Liability

The App is provided on an "AS IS" and "AS AVAILABLE" basis. We make no guarantees that the App will be free of bugs, errors, or interruptions.

Content Disclaimer: Dead Souls Daily delivers literary quotes containing themes of sorrow, existentialism, and irony. The App is strictly for entertainment and literary exploration. It is not intended to provide psychological, psychiatric, or medical advice. If you are experiencing genuine mental health distress, please seek the assistance of a qualified medical professional, not an app quoting 19th-century authors.

5. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions.

6. Changes to These Terms

We reserve the right to modify these Terms at any time. We will provide notice of any material changes by updating the "Effective Date" at the top of this document. Continued use of the App following any changes indicates your acceptance of the new Terms.

8. Apple Required Minimum Terms

The following additional terms are required by Apple Inc. ("Apple") and apply to you if you obtained the App from the Apple App Store:

Acknowledgment: These Terms are concluded between you and Dead Souls Daily only, and not with Apple. Dead Souls Daily is solely responsible for the App and its content.
Scope of License: The license granted to you for the App is limited to a non-transferable license to use the App on any Apple-branded products that you own or control, and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions, except that the App may also be accessed and used by other accounts associated with you via Family Sharing or volume purchasing. You may not distribute or make the App available over a network where it could be used by multiple devices at the same time, nor may you transfer, redistribute, or sublicense the App.
Maintenance and Support: Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App.
Warranty: Dead Souls Daily is solely responsible for any product warranties, whether express or implied by law. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App to you; and, to the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App.
Product Claims: Dead Souls Daily, not Apple, is responsible for addressing any claims of the end-user or any third party relating to the App, including, but not limited to: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.
Intellectual Property Rights: In the event of any third-party claim that the App or your possession and use of the App infringes that third party's intellectual property rights, Dead Souls Daily, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.
Legal Compliance: You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
Third-Party Terms of Agreement: You must comply with any applicable third-party terms of agreement when using the App.
Third-Party Beneficiary: Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms, and upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.

9. Google Play Terms

The following applies to you if you obtained the App from Google Play:

Acknowledgment: These Terms are concluded between you and Dead Souls Daily only, and not with Google LLC ("Google"). Dead Souls Daily is solely responsible for the App and its content, and Google is not a party to these Terms.
Google Play Terms of Service: Your use of Google Play is additionally governed by the Google Play Terms of Service, and your download and use of the App must comply with them.
Maintenance and Support: Google has no obligation whatsoever to furnish any maintenance or support services with respect to the App. Support requests should be directed to support@deadsoulsdaily.com.
Purchases and Refunds: Purchases made through Google Play are processed by Google in accordance with the Google Play refund policies. We cannot issue refunds for Google Play purchases directly.
Claims and Warranties: Dead Souls Daily, not Google, is solely responsible for any product warranties and for addressing any claims relating to the App, including product liability, regulatory compliance, consumer protection, privacy, and intellectual property claims.
Device Permissions: Where the App requests permissions on your device — notifications being the principal one — you may grant or withdraw them at any time in your Android system settings. Withdrawing notification permission will stop the daily delivery, which is, admittedly, the entire point of the App.
